1¡¢The procedure in the Environmental Management Registration on the First Import of Chemicals and how long will it take?

1£©Foreign business concerns or their agents who want to export chemicals to China should obtain the ¡°Application Form for Registration of Environmental Management on the First Import of Chemicals¡± and fill in. Please submit it accompany its material safety date sheet (MSDS) to the Chemical Registration Center of SEPA (hereinafter referred to as the ¡°CRC-SEPA¡±).

2) CRC-SEPA shall examine the application of registration, if the application conforms to the provision, the CRC-SEPA shall send the ¡° Notice on Fees for Environmental Management Registration on First Import of Chemicals¡± to the applicant.

3) The applicant pays a fee of registration according to the ¡°Notice on Fee¡±.

4) When the CRC-SEPA receive the Registration Fee, CRC-SEPA shall send the invoice and the ¡°Notice on Acceptation of Application for the Environmental Management Registration on First Import of Chemicals¡± to the applicant. The application of registration will be sent to the ¡°State Committee for Evaluation of Chemicals¡±.

5) The State Committee and SEPA will examine the application of registration. If the chemical was approved, SEPA shall issue ¡°Registration Certificate for Environmental Management on Import/Export of Chemicals¡±.

About the time for examination of the application cannot exceed 180 days calculated from the date after the Notice on Acceptation is sent by CRC-SEPA. Please refer to Article 16 in the Regulation.

2¡¢Definition of ¡°Foreign business concerns or their agents¡± in the Regulation

¡°Foreign business concerns or their agents¡± refers to seller who want to export chemicals to China.

3¡¢Could the application of registration be sent to the CRC-SEPA through Email or Fax?

The application of registration must be sent to the CRC-SEPA through mail.

4¡¢The CRC-SEPA had already published the ¡°Inventory of Existing Chemical Substances in China¡± (hereinafter referred to as the ¡°Inventory¡±), the chemical isn¡¯t included in the ¡°Inventory¡±  need be registered, but the chemical is included in the ¡°Inventory¡±. Need it be registered?

The ¡°Inventory¡± hasn¡¯t relation to ¡°Regulations for Environmental Management on the First Import of Chemicals and the Import and Export of Toxic Chemicals¡±. Now ¡°Regulations for Environmental Management on the First Import of Chemicals and the Import and Export of Toxic Chemicals¡± is being implemented in China. In the Article 9, It is already indicated that ¡°Foreign business concerns or their agents, when exporting to China any chemicals £¨except for pesticides£© which have not been registered in China, must apply to the SEPA for Registration of Environmental Management on the First Import of Chemicals, shall fill in the Application Form for Registration of Environmental Management on the First Import of Chemicals.¡±

6¡¢How to pay the Registration Fee?

The applicant could pay the Registration Fee according to the ¡°Guideline for Remittance¡± or pay a (dollar or RMB) cheque and also could pay the cash if the registration fee within RMB2000. (Note: the equivalent RMB according to the exchange rate on the day of payment)

7¡¢How to apply the group of chemical products

Applicant who want to apply the chemical products as a group, please refer to ¡°Notice on application for ¡®product group¡¯ registration¡°. Fill in one application form only, fill the name of group in the column of usual name. Submit application form accompany with the product list and MSDS of all products to CRC-SEPA.
